Easton Public Library Conference Room – March 22, 2010

The Easton Police Commission Special Meeting was called to order at 5:35 P.M. by Chairman Robert Nicola.

I. PRELIMINARY BUSINESS:

A. Correspondence
1. State Traffic Commission Authority – completed form for Easton mailed to State Traffic Commission.
2. Chief Peck’s e-mail from State Representative Fawcett regarding Regional approach to Route 136 traffic enforcement - it was reported that we are enforcing truck violators and will work with Fairfield & Westport.
3. Responded to B. Dacey regarding FOI request. Based on investigation, no records will be issued.
4. Letter to Police Officer Candidate Garafola that he was not selected for hire.
5. Letter to SPO Tibbals from Chief Solomon commending his outstanding police work involving medical assistance rendered to a motorist.


II. REPORTS:

A. Police, Animal and Alarm reports were reviewed and found to be in order. The Commission approved all reports without comments or questions.

III. OLD BUSINESS:

A. Traffic Control Matters
1. There was a request for a 4 way stop sign at North Park Avenue and Rock House Road. Based on the investigation, the Chief reported that a stop sign was not warranted. Commissioner Colangelo made a motion to adopt Officer Brennan’s findings not to install two (2) additional stop signs, but might install “Stop Ahead” signs. Chief noted that the Town of Redding would have to be contacted for any signs on the southbound side of North Park Avenue. The motion was seconded by Vice Chairman Martin and approved unanimously.

2. Review of Special Permit for 911 Memorial- It was determined that the placement of the 911 Memorial would have no impact on public safety.

B. Officer Brennan’s suggestion to extend the expiration date for the Municipal Towers List to two (2) years was tabled until the next meeting. Chairman Nicola will review the regulation.

C. The Chief reported that the 2010-2011 Department budget needs to be reviewed for possible reductions; suggestions include a police vehicle, overtime reduction and other areas of the budget.


IV. NEW BUSINESS:

A. Approval of Minutes- Vice Chairman Martin made a motion to approve the minutes from the February 8th Regular Meeting and the February 16th Special Meeting; motion was seconded by Commissioner Colangelo. Vice Chairman Martin made a motion to approve the minutes of the Special Meeting on March 1st and Chairman Nicola seconded. Both motions approved unanimously.

B. Commissioner Colangelo made a motion to note the correspondence
regarding the Garden Club’s Garden Mart to be held on May 8, 2010. Vice Chairman Martin seconded and motion passed unanimously.








Commissioner Colangelo made a motion to go into Executive Session at 6:13 P.M.; seconded by Commissioner Gelfand and passed unanimously.

Returned to Regular Session at 6:53 P.M. There were no motions made or votes taken.

Commissioner Colangelo made a motion to adjourn at 6:53 P.M., seconded by Vice Chairman Martin and passed unanimously.

Meeting by Town Clerk, W. Derek Buckley and took his place at the start of the
meeting as an official member of the Commission which was noted by
Chairman, Robert Maquat at the start of the meeting.

OTHER ITEMS FOR DISCUSSION AND/OR ACTION
1. Adjudication of application by the Town of Easton to amend Special Permit SP-93-3, Easton
Public Library, 691 Morehouse Road, to authorize the construction of a 9/11 Memorial
within the green in front of the library building. (Public hearing closed 3/08/10) – The
chairman read in its entirety a hand-written document entitled “DRAFT PROPOSED
RESOLUTION, application to Amend Special Permit #SP-93-3, Easton Public Library.”
Minor corrections were made to include additional information as to the specific numbers as
to Town vote at the Town Meeting, the official maps noted with their respective dates the
modification of the word “shall” to “should” B) Resolution, Condition 1, to provide the
applicant with more flexibility in construction of the memorial and for protection of existing
trees. Motion was made by Robert Maquat, seconded by Steve Carlson, to approve the
amendment to Special Permit SP-93-3, Easton Public Library, 691 Morehouse road to
authorize the establishment of a 9/11 Memorial structure on the public green between the
Library Building and the Town Hall in accordance with the findings and conditions noted in
the document noted “DRAFT PROPOSED RESOLUTION, application to Amend Special
Permit #SP-93-3, Easton Public Library.” The vote was unanimous, 5-0, motion carried.

ADMINISTRATIVE
3. Correspondence: The chairman noted that he had received from the First Selectman, Thomas
A. Herrmann, an 8-24 referral dated March 19, 2010 regarding a request to permit the leasing
of three classrooms in the northeast corner of the former Samuel Staples Elementary School,
660 Morehouse Road by The Speech Academy. The Chairman noted a document entitled
“Proposal, Private Special Education School, The Speech Academy, The Speech Academy,
Director/Founder: Toni Giannone, Speech/Language Pathologist”.

3. Correspondence (continued)
The First Selectman, Thomas Herrmann, supplemented the information supplied in the
document submitted by The Speech Academy. Mr. Herrmann stated that there had been a
review of the parking at the former Samuel Staples Elementary School by John Hayes and
that a parking plan was to be implemented. Mr. Hayes stated that the parking plan showed
the potential for an additional 35 parking spaces. Mr. Herrmann stated that the Magnet School
previously slated to occupy space at the former elementary school had found other space and
that The Speech Academy should only have a fairly minimal effect on parking. It was noted
that the drop off and pick-up of special education students would be via small school buses
between the hours of 8:00am and 2:30pm and that this was also a high traffic time for the
Easton Country Day School and the Senior Center. It was also noted that the entrance to The
Speech Academy would be through the north side of the building. The chairman noted that
this use is consistent with the Town Plan of Conservation and evelopment and read from Page
88 (B) “Municipal Center”. Motion was made by Robert Maquat, seconded by Wallace
Williams, to find that the proposed use, the leasing of three classrooms in the northeast corner
of the former Samuel Staples Elementary School, 660 Morehouse Road by The Speech
Academy, to be a favorable use, consistent with the Town Plan of Conservation and
Development and acknowledged page four of the packet submitted, “Proposal, Private Special
Education School, The Speech Academy”. The vote was 5-0, vote unanimous, motion
carried.

2. Adjudication of application by Town of Easton to modify the provisions of a greenbelt
easement established on Town property adjacent to Banks Road, of approximately 86 feet

hearing closed 2/22/10) The Chairman noted that Planning and Zoning had received a copy
of letter dated February 19, 2010 from Patti & Allan Popp, Owners, Sport Hill Farm, LLC,
detailing two proposals submitted to the Board of Selectmen. First Selectman, Thomas
Herrmann stated that the Board of Selectmen at their meeting of March 18, 2010 had selected
Proposal 2. The chairman noted the letter dated January 26, 2010 sent to the Board of
Selectmen by the Planning and Zoning Commission regarding the 8-24 Referral, relative to
proposed farming uses on Town property at Morehouse and Banks Roads and noted that in
that letter the use for farming had been recommended by the Planning and Zoning
Commission, but not the authorization of the 8 foot deer control net (fence) within the
greenbelt easement area as not enough information had been supplied about the proposed
extent of the lease area, the full extent of proposed fencing and whether greenbelt areas are to
be incorporated therein. The two areas to be farmed were noted on the map, Parcels A and B,
and the extent of the 8 foot deer control net fencing which is to be installed inside the
stonewalls starting on Banks Road and continuing down Morehouse Road, only to extent of
Parcels A and B.

The chairman noted the existing Greenbelt Easement for the Town property and that there
were four modifications which may be needed as their uses are currently prohibited under the
current easement: 1. the removal or adding of top soil; 2. erection of fences or walls; 3.
entering by any member of the general public and 4. entering the area of the Preservation
Easement for any purpose. After a brief discussion motion was made by Robert Maquat,
seconded by Steve Carlson, to modify the existing language of the Greenbelt Easement to
allow for installation of deer fencing of up to 8 foot darkening mesh with lowest visibility
impact and to allow public access within the easement for the proposed activity and that this
Commission has the discretion to ask for removal of the fence if there is to be no farming
activity. It was the sense of the Commission that no structures should be erected, that the
fence should be installed in the most non-offensive way, that here should be no parking of
vehicles or storage of machinery on-site, that no stands should be erected, that a provision
should be made for replacement of driveway if any damage is done through access with
machinery or vehicles and that this activity is subject to review at the end of the growing
season. The chairman noted that John Hayes, the Land Use Director would prepare the
revised language of the Greenbelt Easement and that it would only apply to Parcels A and B
as noted on the map. The vote was unanimous, 5-0, motion carried.

ADMINISTRATIVE
3. Correspondence (continued)

The Chairman noted an e-mail forwarded to him by the Planning and Zoning Secretary from
Rajeev Chennattu, regarding Brito-33 Norton Road property. The Chairman read the e-mail
to the Commission and the Commission determined that they would like a report from the
Zoning Enforcement Officer addressing the issues raised in the e-mail by Mr. Chennattu.

OTHER ITEMS FOR DISCUSSION AND/OR ACTION
8. Review draft of Revised floodplain regulations (FEMA)- The Land Use Director, John
Hayes, submitted for the Commission’s review a “Preliminary Draft” set of mandatory
amendments to the Easton Zoning and Subdivision Regulations for FLOOD PLAIN
MANAGEMENT. After a brief description, the Commission determined to schedule a
public hearing April 26, 2010 to allow for statutory review by the State of CT, Department of
Environmental Protection, Inland Water Resources Division, the regional planning agencies,
adjacent towns and Aquarion Water Company, based on the recommended changes the Land
Use Director deemed necessary to be in compliance with FEMA.

minutes were approved as amended. The vote was unanimous, 4-0, motion carried (Steve
Carlson did not vote).
Minutes for 1/25/10 – On Motion by Steve Carlson, seconded by Wallace Willams, the
minutes were approved as amended. The vote was unanimous, 5-0, motion carried.

A motion was made by Steve Carlson to adjourn the meeting, seconded by Wallace Williams, and passed by unanimous vote at approximately 8:45pm.

Minutes


Present: Mark Pompa-Chair, Elise Broach-Clerk, Chris Griffin, Claire Gold, Fred Knopf, Andy Kachele, Salvatore Tartaglione, Lee Hanson arrived later.
Absent: Arthur Laske
Also present: Thomas Herrmann - First Selectman, Scott Centrella-Selectman, Robert Lessler-Selectman, John F. Campbell-Treasurer, and Grace Stanczyk-Comptroller.

Mark Pompa presented the proposed budget for the fiscal year 2010/2011. The increases reflected a 0% increase for the General Government and Public Works, a 3.6% total increase in Public Safety, a minus 3.3% in Public Health, and a 1.5% in other departments. The main budget drivers are Fringe Benefits and Pension costs as well as an increase in Capital.

Alfred Treidel presented the Easton Board of Education portion of the Town’s Budget.

Mark Lewis presented the Region 9 2010-11 budget.

The public was then invited to ask questions or make comments.


The Hearing ended at 9:45 p.m.
